These Terms of Service ("Terms") form a legally binding agreement between you and NewLife Naturals, Inc., a California corporation headquartered in Encino, California ("NewLife Naturals," "we," "us," or "our"). These Terms govern your access to and use of our website, any subdomains, and any related services we provide (collectively, the "Site"), as well as your purchase and use of any products offered through the Site, including dietary supplements, personal care products, and medical devices (collectively, the "Products").

By accessing the Site, creating an account, subscribing to any service, or purchasing any Product, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not use the Site or purchase any Product.

IMPORTANT: SECTION 18 CONTAINS A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER. BY AGREEING TO THESE TERMS, YOU AGREE TO RESOLVE DISPUTES WITH NEWLIFE NATURALS THROUGH INDIVIDUAL BINDING ARBITRATION RATHER THAN IN COURT, AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION. PLEASE READ SECTION 18 CAREFULLY BEFORE USING THE SITE OR PURCHASING ANY PRODUCT.

We may update these Terms from time to time. When we do, we will post the revised version on the Site and update the "Last Updated" date above. Your continued use of the Site or purchase of Products after any update constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

These Terms also incorporate, and your use of the Site and Products is also subject to, the following additional policies, each of which is available on the Site (together with these Terms, the "Agreement"):

If there is any conflict between these Terms and any additional policy, these Terms control unless the additional policy expressly states otherwise.

1. Eligibility

To use the Site or purchase any Product, you must be at least 18 years old, a resident of the United States, and legally able to enter into a binding contract in your state of residence. By using the Site, you represent and warrant that you meet these requirements.

If you are using the Site on behalf of a business, healthcare practice, or other entity, you further represent that you have the authority to bind that entity to these Terms, in which case "you" refers to both you personally and the entity.

NewLife Naturals reserves the right to refuse service, terminate accounts, cancel orders, or remove content at our sole discretion.

2. Medical Disclaimer — This Site Does Not Provide Medical Advice

THE SITE AND ALL CONTENT, PRODUCTS, AND INFORMATION PROVIDED THROUGH IT ARE FOR GENERAL INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. THEY ARE NOT, AND ARE NOT INTENDED TO BE, A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

NewLife Naturals focuses on menopause care, women's health, personal care, and wellness. Our content may discuss topics including menopause, perimenopause, hormonal changes, vaginal and urinary health, sexual wellness, sleep, mood, and related subjects. None of this content is intended to diagnose, treat, cure, or prevent any disease or medical condition.

No physician-patient, therapist-patient, or other healthcare professional relationship is created between you and NewLife Naturals, its employees, contractors, or agents by your use of the Site, communication with our team, purchase of a Product, or participation in any quiz, questionnaire, or consultation feature offered on the Site.

3. Product Categories and Specific Disclaimers

NewLife Naturals sells multiple categories of products. Different legal rules and disclaimers apply to each. Please read this section carefully for each type of Product you purchase.

3.1 Dietary Supplements

Our dietary supplements are intended to supplement the diet and are not drugs. Statements made about our dietary supplements on the Site, on product packaging, or in marketing materials have not been evaluated by the U.S. Food and Drug Administration (FDA). These Products are not intended to diagnose, treat, cure, or prevent any disease.

Individual results vary and depend on many factors, including health status, diet, and lifestyle. Testimonials and reviews represent individual experiences and are not a guarantee of results for any other person.

3.2 Personal Care Products

Our personal care products are intended for external or topical use, or for use as otherwise specified on the product label. Always read and follow the label, warnings, and use instructions. Discontinue use and consult a healthcare provider if you experience irritation, a rash, or any other adverse reaction.

3.3 Medical Devices

Certain Products we offer are medical devices regulated by the FDA. Medical devices are subject to additional rules:

         You must use medical devices only in accordance with the labeling, Instructions for Use (IFU), and any prescribing information provided with the Product.

         Off-label use (use outside the device's FDA-cleared indications) is not recommended, is not supported by NewLife Naturals, and is at your own risk.

         If a medical device is prescription-only (Rx), you may purchase and use it only under the direction of a licensed healthcare provider. Prescription requirements apply regardless of how the Product is purchased.

         You are responsible for reading, understanding, and following all IFU and safety information. If you do not understand any instruction, contact your healthcare provider before use.

         Report any adverse event, malfunction, or injury associated with a medical device to NewLife Naturals at support@newlifenaturals.com and, where appropriate, to the FDA's MedWatch program.

3.4 Allergies, Sensitivities, and Adverse Reactions

Every Product's ingredient list is available on the Product page and on the Product packaging. It is your responsibility to review ingredients before purchasing and using any Product. If you have a known allergy or sensitivity to any listed ingredient, do not purchase or use the Product.

NEWLIFE NATURALS IS NOT RESPONSIBLE FOR ANY ADVERSE REACTION TO ANY PRODUCT OR ANY INGREDIENT IN ANY PRODUCT. DISCONTINUE USE IMMEDIATELY AND CONSULT A HEALTHCARE PROVIDER IF YOU EXPERIENCE ANY ADVERSE REACTION. WHEN IN DOUBT ABOUT WHETHER A PRODUCT IS APPROPRIATE FOR YOU, CONSULT YOUR HEALTHCARE PROVIDER BEFORE USING IT.

4. California Proposition 65 Notice

Some Products sold on the Site may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. Where applicable, a specific Prop 65 warning will appear on the Product page or Product packaging. For more information, visit www.P65Warnings.ca.gov.

5. Orders, Pricing, and Payment

When you place an order on the Site, you are making an offer to purchase that is subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, Product unavailability, shipping restrictions, or any violation of these Terms.

All prices are listed in U.S. dollars and are subject to change without notice. If a Product is mispriced on the Site, we reserve the right to cancel the order, even after confirmation or charge, and issue a refund.

By providing payment information, you represent that you are authorized to use the payment method and that all billing information is accurate. Payment is due at the time of order. Applicable taxes and shipping fees will be added at checkout.

We may limit quantities of any Product per person, per household, or per order. Bulk, wholesale, reseller, or practitioner purchases require separate written authorization through our Wholesale or Practitioner Inquiry process.

6. Subscriptions and Automatic Renewal

If you enroll in a subscription, auto-ship, or recurring delivery program, the following terms apply, in compliance with California's Automatic Renewal Law (Cal. Bus. & Prof. Code § 17600 et seq.) and the federal Restore Online Shoppers' Confidence Act (ROSCA):

         Recurring charges. Your subscription will automatically renew at the interval you select (e.g., every 30, 60, or 90 days), and the payment method on file will be charged the then-current subscription price plus any applicable taxes and shipping, until you cancel.

         Advance notice of price changes. If we change the subscription price, we will provide advance notice by email to the address on file before any increase takes effect.

         Cancel anytime. You may cancel your subscription at any time through your account on the Site, by emailing support@newlifenaturals.com, or by contacting customer care. To avoid being charged for an upcoming shipment, you must cancel before the next renewal date.

         No refunds for shipped orders. Cancellation stops future renewals but does not automatically refund orders that have already shipped. Refund and return eligibility for already-shipped orders is governed by our Return Policy.

         Free trials and promotional offers. If you accept a free trial or introductory offer, the terms of the offer (including the date on which regular billing begins) will be clearly disclosed at sign-up. Unless you cancel before the trial ends, you will be charged the regular subscription price.

7. Shipping and Risk of Loss

We ship Products to addresses in the United States only, unless otherwise stated on the Site. Shipping times are estimates, not guarantees. We are not responsible for delays caused by carriers, weather, natural disasters, or other events outside our control.

Title to Products and risk of loss pass to you upon delivery to the carrier. Once a Product leaves our fulfillment facility, any loss or damage in transit is between you and the carrier, although we will assist with claims where reasonable.

If a Product arrives damaged, contact us within seven (7) days of delivery at support@newlifenaturals.com with photos and order information so we can help resolve the issue.

8. Returns and Refunds

Returns, refunds, and exchanges are governed by our Return Policy, available on the Site and incorporated here by reference. In general, unopened Products in original condition may be returned within the return window stated in the Return Policy. Opened Products, medical devices, and certain intimate-use personal care items may be non-returnable for hygiene and safety reasons, except where required by law or in the case of a defective Product.

9. Text Message (SMS/MMS) Marketing

If you opt into SMS or MMS messaging from NewLife Naturals — by providing your mobile number, checking a subscription box, or texting a keyword to our short code — you consent to receive recurring automated marketing and transactional text messages from us, including messages sent using automatic telephone dialing systems. Your consent is not a condition of purchase.

Message types may include order updates, shipping notifications, back-in-stock alerts, abandoned-cart reminders, promotions, new Product announcements, and other marketing messages.

Message frequency varies. Message and data rates may apply depending on your mobile carrier and plan. NewLife Naturals does not charge for messages, but your carrier may. Contact your carrier for pricing details.

To opt out: Reply STOP to any message to unsubscribe. You will receive a one-time confirmation that you have been opted out. For help, reply HELP or email support@newlifenaturals.com.

We are not responsible for undelivered, delayed, or misdirected messages. Not all carriers or devices are supported. If you change your mobile number, you agree to notify us so we can update our records.

10. User Reviews, Submissions, and Content

The Site may allow you to submit reviews, comments, photos, testimonials, questions, or other content ("Submissions"). By submitting any Submission, you grant NewLife Naturals and its affiliates a non-exclusive, royalty-free, worldwide, perpetual, transferable, sublicensable, and irrevocable right and license to use, reproduce, modify, adapt, translate, publish, distribute, display, and otherwise use the Submission in any media, for any lawful purpose, including marketing and advertising, without further notice or compensation to you.

You also grant us the right to use your name, social media handle, image, and likeness in connection with the Submission. You waive any so-called "moral rights" you may have in the Submission. You retain ownership of your underlying copyright and publicity rights subject to the license granted above.

You represent and warrant that:

         The Submission is your original work, or you have all rights necessary to grant the license above.

         The Submission is truthful and accurate, including any claims about Product results or experiences.

         The Submission does not violate the rights of any third party, including intellectual property, privacy, or publicity rights.

         The Submission does not contain unlawful, defamatory, obscene, threatening, harassing, or otherwise objectionable content.

         The Submission does not contain any medical claims attributed to NewLife Naturals or any Product beyond what appears on the Product label.

We reserve the right, but are not obligated, to monitor, edit, or remove any Submission at our sole discretion, including Submissions that violate these Terms, that we believe may violate FDA, FTC, or other regulations, or that create liability risk.

11. Intellectual Property

The Site and all its content — including the NewLife Naturals name, logos, trademarks, product names, product designs, formulations, text, graphics, images, photographs, videos, audio, software, and the overall look and feel — are owned by NewLife Naturals or its licensors and are protected by United States and international copyright, trademark, trade dress, patent, trade secret, and other intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, modify, create derivative works of, publicly display, publicly perform, or exploit any portion of the Site or its content without our prior written permission. Any unauthorized use terminates this license automatically.

"NewLife Naturals" and our product names and logos are trademarks of NewLife Naturals, Inc. All other trademarks referenced on the Site are the property of their respective owners.

12. Copyright Infringement Claims (DMCA)

We respect the intellectual property rights of others. If you believe that content on the Site infringes your copyright, please send a written notice to our designated agent containing the following:

         Your physical or electronic signature, or that of a person authorized to act on your behalf.

         Identification of the copyrighted work claimed to be infringed.

         Identification of the material you claim is infringing and its location on the Site (such as a URL).

         Your contact information, including address, telephone number, and email.

         A statement that you have a good-faith belief that the use complained of is not authorized by the copyright owner, its agent, or the law.

         A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

The Site may contain links to third-party websites, services, or resources that are not controlled by NewLife Naturals. We provide these links for convenience only and do not endorse, warrant, or assume responsibility for any third-party site or its content. Your use of any third-party site is at your own risk and subject to the terms and privacy policies of that site.

14. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS, CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEWLIFE NATURALS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, INFORMATION, OR PRODUCT DESCRIPTION ON THE SITE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEWLIFE NATURALS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE PRODUCTS OR SERVICES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCT, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THE PRODUCTS, OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU PAID TO NEWLIFE NATURALS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the limitation of certain damages, so some of these limitations may not apply to you. In that case, our liability is limited to the minimum extent permitted by law.

Nothing in these Terms limits any right you may have under applicable law that cannot be waived by contract, including any non-waivable warranties under the California Consumer Legal Remedies Act or similar consumer protection laws.

16. Indemnification

You agree to indemnify, defend, and hold harmless NewLife Naturals and its affiliates, officers, directors, employees, agents, licensors, suppliers, and service providers from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your breach of these Terms; (b) your use or misuse of the Site or any Product; (c) your Submissions; (d) your violation of any law or the rights of any third party; or (e) your negligence or willful misconduct.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense. You may not settle any claim without our prior written consent.

17. Informal Dispute Resolution

Before filing any arbitration or lawsuit, you agree to first attempt to resolve any dispute, claim, or disagreement (a "Dispute") informally with NewLife Naturals. To start this process, you must send a written Notice of Dispute that includes:

         Your name, address, email address, and phone number.

         A detailed description of the Dispute, including the date of the incident, the Products involved, order numbers, and any relevant facts.

         The specific relief you are seeking, including any amount of money claimed and how you calculated it.

You and NewLife Naturals will then attempt to resolve the Dispute through informal negotiation for at least sixty (60) days from the date the Notice of Dispute is received. During that period, we will meet in good faith — by phone, video, or in person — to discuss and attempt to resolve the Dispute (the "Dispute Resolution Conference"). If you are represented by counsel, you must still participate personally in the Dispute Resolution Conference.

If the Dispute is not resolved within sixty (60) days after receipt of the Notice of Dispute, and the Dispute Resolution Conference has been completed, either party may proceed to arbitration or, where permitted, small claims court.

18. Binding Individual Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

18.1 Agreement to Arbitrate

Except for the limited exceptions in Section 18.5, any Dispute between you and NewLife Naturals that is not resolved through the informal process in Section 17 shall be resolved exclusively by final, binding, individual arbitration. You and NewLife Naturals are each giving up the right to have Disputes resolved in court by a judge or jury.

18.2 Arbitration Provider and Rules

The arbitration shall be administered by JAMS under its Streamlined Arbitration Rules and Procedures then in effect (the "Rules"), as modified by these Terms. If JAMS is unavailable or declines to administer the arbitration, the parties will agree on an alternative provider, or a court with jurisdiction may appoint one. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this Section 18.

The arbitration shall be conducted by a single neutral arbitrator. The arbitration shall be conducted in English and shall take place in Los Angeles County, California, or at another location agreed to by the parties, or, at your election, by telephone or videoconference. If the amount in controversy is $25,000 or less, the arbitration may be conducted based on written submissions only, unless the arbitrator determines a hearing is necessary.

18.3 Class Action Waiver

YOU AND NEWLIFE NATURALS AGREE THAT ANY DISPUTE WILL BE BROUGHT IN EACH PARTY'S INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.

The arbitrator may not consolidate the claims of multiple persons and may not otherwise preside over any form of class, collective, or representative proceeding. If a court decides that applicable law precludes enforcement of any part of this Section 18.3, then the affected claim must be severed from the arbitration and brought in the courts identified in Section 19, and the remainder of Section 18 shall remain in effect.

18.4 Coordinated or Mass Filings

If 25 or more similar arbitration demands are filed against NewLife Naturals by or with the assistance of the same or coordinated counsel ("Coordinated Cases"), the parties agree that the following procedures apply in addition to the Rules, to promote efficient and fair resolution:

         After all Notices of Dispute have been delivered, counsel for the claimants and NewLife Naturals shall meet and confer in good faith to select a reasonable number of representative "bellwether" cases — half chosen by each side — to be arbitrated first.

         Only the selected bellwether cases may be filed with the arbitration provider until the bellwether arbitrations are complete. Filing fees are not owed on cases that have not yet been filed in accordance with this process.

         Applicable statutes of limitations are tolled for claimants who have delivered compliant Notices of Dispute while this process is pending.

         After the bellwether arbitrations conclude, the parties will participate in a global mediation of the remaining Coordinated Cases, with each side sharing mediation fees equally.

         If mediation does not resolve the remaining Coordinated Cases, those claims may be brought in the courts identified in Section 19, subject to all applicable procedural rules and defenses, including any objection to class certification.

18.5 Exceptions

This Section 18 does not apply to: (a) any claim for injunctive or equitable relief for alleged infringement or misappropriation of intellectual property; (b) individual claims that qualify for small claims court, which may be brought in the claimant's county of residence or in Los Angeles County, California; or (c) claims that cannot be arbitrated as a matter of law.

18.6 Time Limit to Bring Claims

ANY CLAIM OR DISPUTE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM OR DISPUTE FIRST AROSE, OR SUCH SHORTER PERIOD AS REQUIRED BY APPLICABLE LAW. OTHERWISE, THE CLAIM OR DISPUTE IS PERMANENTLY BARRED.

18.7 Opt-Out Right

You may opt out of this Section 18 by sending written notice of your decision to opt out to NewLife Naturals, Inc., Attn: Legal Department, 16000 Ventura Blvd, Suite 400, Encino, CA 91436, or by email to support@newlifenaturals.com, within thirty (30) days after you first accept these Terms. Your opt-out notice must include your name, address, and a clear statement that you wish to opt out of arbitration. If you opt out, all other provisions of these Terms, including the class action waiver in Section 18.3, will still apply.

19. Governing Law and Venue

These Terms and any Dispute arising out of or relating to them or your use of the Site or any Product are governed by the laws of the State of California, without regard to its conflict-of-laws principles, and by applicable federal law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

For any claim not subject to arbitration, you and NewLife Naturals agree to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California, and you waive any objection based on inconvenient forum or lack of personal jurisdiction.

20. California Consumer Rights

20.1 Your Privacy Rights

California residents have specific rights under the California Consumer Privacy Act and the California Privacy Rights Act (together, the "CCPA"), including the right to know what personal information we collect, the right to delete personal information, the right to correct inaccurate information, the right to opt out of the sale or sharing of personal information, and the right to limit the use of sensitive personal information. These rights and how to exercise them are described in our Privacy Policy and Consumer Health Data Privacy Policy.

20.2 Shine the Light

California residents may request information about the categories of personal information (if any) we disclosed to third parties for those third parties' direct marketing purposes during the preceding calendar year. To make such a request, email support@newlifenaturals.com with the subject line "Shine the Light Request."

20.3 Consumer Complaints

In accordance with California Civil Code § 1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by writing to 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

21. Termination

We may suspend or terminate your access to the Site, your account, or your ability to purchase Products at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Site and close your account at any time. Sections that by their nature should survive termination — including Sections 2, 3, 10, 11, 14, 15, 16, 17, 18, 19, and 22 — will survive.

22. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, Consumer Health Data Privacy Policy, Return Policy, and any other policies referenced on the Site, are the entire agreement between you and NewLife Naturals concerning the Site and the Products, and supersede all prior or contemporaneous agreements.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms does not waive that right or provision.

Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Force Majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, supply chain disruptions, utility or internet outages, or governmental actions.

Relationship of the Parties. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and NewLife Naturals.

Headings. Section headings are for convenience only and do not affect interpretation.

Electronic Communications. By using the Site or providing us with your email or phone number, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

Export Control. The Site and Products are controlled and operated from the United States. We make no representation that the Site or any Product is appropriate or available for use in other locations. You may not use or export the Site or any Product in violation of U.S. export laws or regulations. You represent that you are not located in any country subject to a U.S. government embargo and that you are not on any U.S. government list of prohibited or restricted parties.

No Reliance. You acknowledge that you have not relied on any statement, representation, warranty, or promise made by NewLife Naturals or any third party that is not expressly set forth in these Terms or on a Product label. Any statements made on the Site, in marketing materials, or by customer service representatives are not medical advice, are not guarantees of results, and do not modify these Terms. You are responsible for your own evaluation of any Product before purchase and use.

Prevailing Party Fees. In any action or proceeding to enforce these Terms, or arising out of or relating to these Terms, the Site, or any Product — including any arbitration under Section 18 or any court proceeding under Section 19 — the prevailing party shall be entitled to recover its reasonable attorneys' fees, expert witness fees, arbitration fees, and costs, in addition to any other relief awarded.
